Thompson & Smith Industries, LLC is the primary legal entity entering into and responsible for all contractual obligations under these Terms, and “TTS Armament” refers to the Company’s trade name/brand. These Terms and Conditions (“Terms”) govern your access to and use of the website located at ttsarmament.com (the “Site”) and the purchase of firearms, tactical equipment, tools, and related products (collectively, the “Products”) offered under the TTS Armament brand name.
By accessing the Site or purchasing any Products, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you are prohibited from using this Site and purchasing our Products.
1. Age Requirements
By using this Site, you represent and warrant that you are at least 18 years of age. You must be at least 18 years old to purchase long guns or ammunition, and 21 years old to purchase handguns or receivers, in accordance with federal and state laws. It is your responsibility to ensure you meet the legal age requirements for the items you purchase.
2. Use of Website; Acceptance of Terms
By accessing, browsing, or using the Site in any manner (including creating an account, placing an order, or otherwise interacting with the Site), you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, do not use the Site or purchase Products.
3. Pricing and Payment
All prices are subject to change without notice. All sales will appear as Thompson & Smith Industries, LLC on your billing statement.
4. Compliance with Laws
You are solely responsible for knowing and complying with all applicable federal, state, and local laws, regulations, and ordinances regarding the purchase, possession, transfer, import/export, transportation, storage, and use of firearms, ammunition (if offered), receivers, frames, parts, accessories, tools, and related items in your jurisdiction. We do not provide legal advice, and nothing on the Site should be construed as legal advice. You must determine whether a Product is legal to purchase, possess, and use where you live.
5. Restricted Items; Shipping Restrictions
We comply with all applicable laws and carrier policies and reserve the right to restrict, refuse, or cancel shipments at our sole discretion. We will not ship Products (including restricted parts, magazines, or other items) to jurisdictions where such Products are prohibited or restricted (including due to capacity limits, feature restrictions, permitting requirements, or other local rules).
It is your responsibility to ensure the Products you order are legal in your jurisdiction and to provide a deliverable shipping address. If you place an order for a restricted or prohibited item, we may cancel the order (in whole or in part). Any applicable fees (including payment processing fees, return shipping, or restocking fees where permitted by law) may be deducted from any refund.
6. Product Safety & Professional Installation
Firearms, firearm parts, and tactical equipment can be dangerous and may cause serious injury or death. You are responsible for safe handling, safe storage, and lawful use of all Products.
Qualified Gunsmith Required / Strongly Recommended. Unless you are properly trained and legally permitted to do so, you must have Products installed, fitted, inspected, tested, and maintained by a qualified gunsmith or other qualified professional. Improper installation, fitting, headspace, torque, staking, timing, or modification can result in catastrophic failure and personal injury.
No Liability for Improper Installation or Misuse. To the maximum extent permitted by law, TTS Armament and Thompson & Smith Industries, LLC disclaim all liability for any damage, injury, death, loss, or claims arising from or related to (a) improper installation or assembly, (b) misuse, negligence, unsafe handling or storage, (c) failure to follow manufacturer instructions or safety warnings, (d) use of incorrect, incompatible, worn, altered, or counterfeit parts, (e) modifications or machining performed by you or any third party, or (f) failure to inspect, maintain, or service any Product.
7. Intellectual Property
All content on this Site, including text, graphics, logos, product designs, and machining specifications, is the exclusive property of TTS Armament and is protected by United States and international copyright, trademark, and patent laws. Unauthorized use or reproduction of our intellectual property is strictly prohibited.
8. Limitation of Liability; Disclaimer of Warranties
Disclaimer of Warranties. To the maximum extent permitted by law, the Site and all Products are provided on an “AS IS” and “AS AVAILABLE” basis. TTS Armament and Thompson & Smith Industries, LLC disclaim all warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement. Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.
Limitation of Liability. To the maximum extent permitted by law, in no event shall TTS Armament, Thompson & Smith Industries, LLC, or any of their owners, managers, officers, directors, employees, contractors, agents, affiliates, successors, or assigns be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to the Site, these Terms, or any Products, even if advised of the possibility of such damages.
Cap on Liability. To the maximum extent permitted by law, the total aggregate liability of TTS Armament and Thompson & Smith Industries, LLC for any claim arising out of or related to the Site, these Terms, or any Products shall not exceed the greater of (a) the amount you paid to us for the Product(s) giving rise to the claim in the six (6) months preceding the event giving rise to the claim, or (b) $100.
Third-Party/Downstream Use. We are not liable for claims arising from use, handling, or transfer of Products by any person other than the purchaser, including any subsequent owner or user.
9. Indemnification
You agree to indemnify, defend, and hold harmless TTS Armament, Thompson & Smith Industries, LLC, and their owners, managers, officers, directors, employees, contractors, agents, affiliates, successors, and assigns from and against any and all claims, demands, actions, suits, proceedings, damages, losses, liabilities, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your access to or use of the Site; (b) your purchase, possession, use, transfer, sale, or other disposition of any Products; (c) your violation of these Terms or any applicable law; (d) your breach of any representation or warranty in these Terms; or (e) your negligence, misconduct, or alleged unlawful activity.
10. Orders; Right to Refuse or Cancel
We reserve the right, at our sole discretion and at any time, to refuse, limit, or cancel any order (in whole or in part), including for reasons such as suspected fraud, suspected unlawful activity, suspected straw purchasing, inventory errors, pricing or listing errors, inability to verify information, shipping restrictions, export control concerns, or any other compliance or business reason. We may also limit quantities per person, per household, per account, per payment method, or per order.
If we cancel an order after your payment has been processed, we will issue a refund to the original payment method in accordance with our policies and applicable law (less any non-refundable fees where permitted). We are not responsible for third-party fees (including bank fees, currency conversion fees, or other charges) incurred by you.
11. Accuracy of Information
While we strive for precision in our descriptions and specifications, TTS Armament does not warrant that product descriptions, pricing, availability, lead times, or other content on the Site are 100% accurate, complete, or error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after an order has been submitted. We reserve the right to cancel orders resulting from such errors.
12. ITAR / Export Controls; No Export
Products sold on this Site may be subject to U.S. export control laws and regulations, including the International Traffic in Arms Regulations (ITAR) (22 C.F.R. Parts 120–130) and/or the Export Administration Regulations (EAR) (15 C.F.R. Parts 730–774).
You represent, warrant, and agree that you will not (and will not allow any third party to) export, re-export, release, or transfer (in-country), directly or indirectly, any Product, technical data, drawings, instructions, or related information obtained from the Site or through a purchase, to any destination, end user, or end use prohibited or restricted by U.S. law, without first obtaining all required U.S. Government authorizations. This includes, without limitation, sending or carrying items outside the United States, shipping to freight forwarders for export, or transferring items to foreign persons as defined by applicable law, where authorization is required.
13. Governing Law (Tennessee); Venue
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles. You agree that any dispute, claim, or controversy arising out of or relating to the Site, these Terms, or any Products shall be brought exclusively in the state or federal courts located in Tennessee, and you consent to the personal jurisdiction and venue of such courts.
